A contract keeps running because notice came too late or was worded wrongly – it happens easily. This article explains three basics that matter for many consumer contracts, such as internet, mobile or a gym.
How long may a contract run?
In standard terms, the first term of a contract for regular services may be two years at most (1). Silent renewal is only allowed if the contract then continues for an indefinite period and you can end it at any time with at most one month’s notice (1). A notice period of more than one month before the first term ends is invalid (1). This rule does not apply to insurance contracts (1); there, the periods in your contract apply.
What does “text form” mean?
If a law or contract requires “text form”, a readable statement naming you as the sender and stored on a durable medium is enough, for example an email or a letter (2). A signature is not required by this definition (2). Still, check which form your contract asks for.
The cancellation button
If consumers can conclude paid continuing contracts on a website, the provider must offer a button labelled “Verträge hier kündigen” or an equivalent, followed by a second button “jetzt kündigen” after you enter your details (3). The provider must confirm receipt immediately in text form, stating content, time and end date (3). If the button is missing, consumers can cancel at any time without notice (3). Financial services are excluded (3).
Practical notes
- Note the term and notice period right after signing.
- Send your notice in a provable way and save the confirmation.
- If unsure, the consumer advice centre (Verbraucherzentrale) can help.
